Consumer Assistance Program Standard Agreement Process

California Code of Regulations, title 16, section 3392.2.1(b)(1) requires STAR-certified test-and-repair Smog Check stations to offer repair assistance services in accordance with a standard agreement for the Bureau of Automotive Repair’s (BAR’s) Consumer Assistance Program (CAP). Below is the process for a station to obtain a CAP standard agreement:

  • After approving a station’s STAR application, BAR’s Licensing Unit sends the station a pre-approval letter, STAR Station Questionnaire, Payee Data Record (STD 204), and instructions to complete the online CAP training program.

  • The station completes and signs the forms, and returns the original documents to CAP’s Standard Agreement Unit (SAU). The station can fax a certificate of completion for the CAP training program to the SAU.

  • The SAU verifies the forms for accuracy and original signatures. A standard agreement is created and mailed to the station, usually within 14 days.

  • The station verifies the information on the standard agreement, then signs and returns it in the postage-paid envelope provided. If the training certificate of completion has not already been faxed to the SAU, it can be enclosed with the standard agreement.

  • Upon receipt of the signed agreement and training certificate, BAR’s Licensing Unit will ensure the station still meets STAR eligibility criteria, after which the SAU will execute the standard agreement. BAR’s Licensing Unit will then activate the STAR privileges electronically, usually within two business days.

Here are a few important reminders to avoid delays in the processing of a CAP standard agreement:

  • The STAR Station Questionnaire and Payee Data Record (STD 204) must be mailed, not faxed, since original signatures are required.

  • All information on the Payee Data Record (STD 204) must be complete and correct. This information is used to process payments and for tax agency reporting.

  • The CAP training program must be completed and the certificate of completion provided to the SAU. This training is unique to CAP and is not included in other BAR-required training. The CAP Training program is available on BAR's website at www.bar.ca.gov.
